Consider and take action on an ordinance authorizing a utility agreement with Hillwood Enterprises, L.P., on behalf of Galveston County Municipal District No. 80 (Executive Director of Development Services)
Staff requests approval on first and final reading.
Background:
On April 28, 2020, the City previously authorized a utility agreement (“Prior Agreement”) with Wilbow-Westleigh LLC ("Wilbow") on behalf of Galveston County Municipal District No. 80 ("MUD 80") related to the approximately 157 acres at the western terminus of League City Parkway, west of the Westwood Subdivision. On September 28, 2021, the Prior Agreement was subsequently assigned and assumed by CND-Westleigh, LLC ("CND"), a new developer proposing to develop the property within MUD 80. Neither Wilbow nor CND closed on the acquisition of the property within MUD 80.
Hillwood Enterprises, L.P. (“Hillwood”) has proposed to acquire the property within MUD 80 for future development and has requested Council’s approval of a new Utility Agreement with MUD 80, clarifying that the prior agreements between Wilbow and CND be superseded and replaced by the proposed utility agreement for the property within MUD 80.
Approval of this ordinance will authorize the execution of a utility agreement between MUD 80, Hillwood, and the City, and will supersede and replace the prior agreement.
