Consider and take action on a request by the Clear Creek Independent School District Department of Military Science for a variance to waive park rental fees and a variance to the Code of Ordinances of the City of League City, Chapter 74, Article I, Section 74-1, entitled “Hours for use of city parks and boat ramps” for overnight use of the Hometown Heroes Park field on November 4-5, 2016 (Director, Parks and Cultural Services)

Background:
Approval of this item, will waive park rental fees and allow overnight use of Hometown Heroes Park for a fundraising event for veterans transitioning to civilian life. Mr. James Courtney, of the Clear Creek Independent School District Military Science Department, is requesting the use of the park’s walking circle and surrounding field area to host the Veterans Relay. The event is designed to raise funds to support organizations that help veterans and their families as they transition from active duty to civilian life. The event is scheduled to begin at 9 p.m. on November 4 and end at 7 a.m. on November 5, 2016.

City policy provides that fees can be waived under certain conditions; however, the proposed fundraising event does not meet all the requirements and is requesting waivers beyond those addressed by the policy. Specifically, the requesting entity is not a 501(c)(3) non-profit organization recognized by the Internal Revenue Service. As such, Council action is necessary to waive fees for the proposed fundraising event. The total estimated cost proposed for waiver is $440, broken down as follows:

· Walking area being used available at no charge = $0
· Use of lights for 10 hours at $24 per hour = $240
· Park Attendant for 10 hours at $20 per hour = $200

As the relay will last through the night of November 4, a variance is required for the 10:30 p.m. closing time as set forth by City Ordinance No. 90-09, Section 74-1. Approximately 100 people are expected to attend. Set-up and clean-up will be the responsibility o...
