Consider and take action on a resolution approving a right-of-way abandonment and conveyance agreement with Jack David Tarpley and Justin Dale Tarpley for the abandonment and conveyance of a 0.418-acre portion of unopened 17th Street abutting and lying between Blocks 164 and 165, Dickinson Townsite Addition in the Perry and Austin League, Abstract No. 19, Galveston County, Texas (Director of Public Works)

Background:
Approval of this resolution will authorize the abandonment and conveyance of a 0.418-acre portion of unopened 17th Street lying between Blocks 164 and 165 in the Dickinson Townsite Addition, Perry and Austin League, Abstract No. 19, Galveston County, Texas to Jack David Tarpley and Justin Dale Tarpley for the purchase price of $27,300.

Jack David Tarpley and Justin Dale Tarpley (Tarpley brothers) have determined to exercise their option to purchase the 0.418-acre portion of 17th for the appraised value as established by the City-commissioned appraiser in accordance with the attached Rule 311 Settlement Agreement. The Rule 311 Agreement resulted from the City’s condemnation of the Tarpley brother’s property for the Shellside Stormwater Management System Project (DR1401). Per the Rule 311 Agreement, the City commissioned the appraisal of the property that established the purchase price of $27,300.

Proceeds from the sale will be deposited in the Right of Way Fund, reserved for City future acquisition of right-of-way.
