Consider and take action on Ordinance No. 2017-12, amending the Code of Ordinances, Chapter 2, Article VI entitled “Disposition of Surplus Property”, repealing all ordinances or parts of ordinances inconsistent or in conflict; providing for severability - Second Reading (Assistant City Manager)

 

Council approved first reading 8-0-0 on April 11, 2017.

 

Background: 

Approval of this item will enable the City Manager to authorize the disposition of surplus property with a value of less than $5,000 without City Council approval and determine the method of disposal. This proposed ordinance also eliminates ambiguity that exits with the current ordinance.

 

While the current ordinance states that "Before any property of the City is sold or offered for sale, the property shall first be declared surplus property by resolution duly adopted by the city council." This was an oversight in the drafting of the ordinance and was not the intent of the Council when the ordinance was revised in 2014 (see the attached data sheet.) Ordinance 2014-07 went on to grant the City Manager the authority to dispose of property with a value of less than $2,500.

 

Increasing this to $5,000 will expedite the disposal of property with limited value, such as furniture, computer equipment, etc.
