Consider and take action on a resolution authorizing an Interlocal Agreement with the Texas Department of Public Safety to retain the services of a Breath Alcohol Technical Supervisor (Chief of Police)

Background:
In 2014, the City of League City authorized a five-year extension on an Interlocal Agreement for a Breath Alcohol Technical Supervisor (BATS) with the cities of Friendswood, Webster, Seabrook, South Houston, Clute, Texas City, Pearland and Galveston County. At that time, the BATS was employed by the City of League City. League City no longer employs a BATS, and the Texas Department of Public Safety (DPS) offered to hire a BATS to service the consortium. DPS advised that they would enter into an Interlocal Agreement with the City of League City to have a single point of contact to service the consortium agencies previously listed, with the exception of Clute.

There is a also a companion Interlocal agreement with the consortium agencies that in deals with the funding for the consortium’s BATS . Each agency will pay its portion of the total annual cost to the City of League City, and League City will pay DPS for the cost for the BATS program. The Interlocal with DPS covers the responsibilities of all parties involved as well as the funding requirements. DPS advised that they would only deal with a consortium for this program because without the consortium there is no protection for DPS. The benefit of this Interlocal Agreement with DPS is that the BATS will serve as a contractor to the consortium instead of an employee of League City, and each agency still receives the benefits of having an intoxilyzer instrument with DPS maintaining the instrument and providing for the training of our officers as needed.
