Title
Consider and take action on a resolution determining that land is needed for the construction and improvements associated with Phase 2 Reconstruction of Turner St and Butler Rd Project (RE1902A), in the City of League City, Texas, specifically: 1) a 0.0927 acre parcel of land believed to be owned by Mark Brittnacher and, 2) a 0.0578 acre parcel of land believed to be owned by Brent G. Langlinais; and authorizing the institution of eminent domain proceedings (Executive Director of Capital Projects)
Background:
If approved, this resolution establishes the Public Necessity to acquire real property interests in certain properties, and authorizes the uses of eminent domain powers, if necessary, for the acquisition of real property interests in the properties.
The scope of this project is to reconstruct approximately 1,800 feet of existing 2-lane asphalt roadway to 24’ wide curb and gutter reinforced concrete pavement along Turner Street from Hobbs to Butler Road and reconstruct approximately 4,300 feet of 2-lane asphalt roadway to 24’ wide curb and gutter reinforced concrete pavement on Butler Road from Turner Street to approximately 400 feet south of Sedona Drive. Currently, the City is awaiting 100% design plans to review and approve.
Staff has exhausted all negotiations with these 2 property owners to complete the acquisition of all needed parcels. To move the project forward, staff is requesting that City Council declare a Public Necessity for the Project and authorize staff to proceed with eminent domain proceedings for the above 2 parcels.
The proposed resolution is being presented to address condemnation law procedural requirements effected by the passage of Senate Bill 18 in 2011.
