Title

Consider and take action on a resolution determining that land is needed for the construction and improvements associated with the League City Parkway Right-Turn Lane addition from Butler Road to IH 45 (ST2004), in the City of League City, Texas, specifically: 1) Parcel 3 - a 0.018-acre parcel of land; and authorizing the institution of eminent domain proceedings (Executive Director of Capital Projects)

Background:

If approved, this resolution establishes the Public Necessity to acquire real property interests in certain properties, and authorizes the uses of eminent domain powers, if necessary, for the acquisition of real property interests in the properties.

The project consists of the addition of a right-turn lane to the existing pavement along League City

Parkway, from west of Butler Road to east of Calder Road, near IH 45. The length of the project is approximately 0.38 miles long, consisting of an additional 12-foot right-turn lane, traffic signal modification and median modification to create an S-median at Calder. These modifications will create a continuous right turn lane from west of Hobbs Rd. to the IH 45 frontage road and eliminate northbound and southbound left turns at Calder.

To move the project forward, staff is requesting that City Council declare a Public Necessity for the Project and authorize staff to proceed with eminent domain proceedings, if necessary, for the above-mentioned parcel.

The proposed resolution is being presented to address condemnation law procedural requirements effected by the passage of Senate Bill 18 in 2011.
