Consider and take action on an ordinance creating a Citizen Data Privacy Committee to provide oversight of the City’s Flock Safety automated license plate reader system (Mayor Long, Mayor Pro Tem Saunders and Council Member Cones)
Background:
Approval of this ordinance will establish a five-member Citizen Data Privacy Committee to provide additional transparency and public oversight regarding the City’s use of the Flock Safety automated license plate reader system.
The Committee will serve in an advisory capacity and will consist of the Mayor, City Auditor, and three citizen members. The Committee’s responsibilities will include:
· Reviewing audit reports and summaries concerning use of the Flock system.
· Reviewing policies governing the collection, access, use, retention, sharing, security, and deletion of Flock data.
· Reviewing compliance with access controls, logging, supervisory review, retention, and information-sharing requirements.
· Reviewing substantiated incidents involving misuse, unauthorized access, or material security breaches.
· Considering public questions and concerns regarding the Flock system.
· Reviewing proposed changes to City policies or practices governing the system.
· Making recommendations regarding privacy protections, transparency, accountability, data security, public education, and responsible use.
· Reviewing the Police Department’s annual report regarding use, auditing, oversight, and administration of the system.
· Performing other advisory duties requested by the City Council.
The ordinance also establishes an audit and reporting process intended to allow the City Auditor and Committee to evaluate use of the system while protecting confidential, law-enforcement-sensitive, and other legally protected information.
