Title

Hold a Public Hearing and take action on a resolution authorizing an amendment to the General Land Office Contract 20-065-141-C780 for the purpose of decreasing the scope by removing the proposed The Landing, Newport and Ellis Landing, and Brittany Bay Subdivision Drainage Improvements from the North League City Drainage Improvement Project (Executive Director of Capital Projects)

 

Background:

A Public Hearing is required to consider a scope change to a project known as North League City Drainage Improvement Projects for the purpose of decreasing the scope by removing the proposed The Landing, Newport and Ellis Landing, and Brittany Bay Subdivision Drainage Improvements from the project per the City’s adopted Citizen Participation Plan.

These projects were included as part of a list of potential drainage projects outlined on the City’s May 2019 General Obligation Bond Referendum based on a high-level study of drainage issues encountered in several of our neighborhoods after Hurricane Harvey. All three were awarded CDBG-DR funding through GLO while the Brittany Bay Subdivision Improvements Project was also awarded a HMGP grant through FEMA. Council awarded a single design contract in April 2021 due to similarity of work in these subdivisions from site to site as well as subdivision to subdivision. RPS Infrastructure, Inc. was selected to design the overflow swale drainage improvements at Brittany Bay, Newport & Ellis Landing, and The Landing by utilizing existing storm sewer outfall easements to provide surface flood relief for adjacent streets to drain into nearby creeks. These easements are typically 10’ wide and fully encumbered with fences, gates, walkways, trees, AC units, etc. A typical swale would require relocation or removal of these items and would alter access to backyards.  Design of the individual projects were completed between December 2021 and May 2022.

Staff has met with each of the subdivision HOA’s as well as property owners of the affected residences to explain the projects and build consensus due to impacts to side and back yards. City staff feels that based on feedback received, it is the consensus of the involved parties that the Brittany Bay, Newport & Ellis Landing, and The Landing drainage improvement projects should not move forward.

Completed plans were submitted to FEMA for each project for review of our request for construction funds. In August 2023 FEMA/TDEM requested a detailed technical drainage study for the projects that was not performed as the cost of the technical study was not justified due to the scope of work and estimated construction cost. The original technical report that was performed was submitted but the agency felt it was not sufficient to meet their requirements. The City was given the option to withdraw the application for Phase II (construction) funding and amend the scope of the project which is the subject of this Public Hearing.

The requested scope change is to remove the proposed four overflow swales in the Brittany Bay Subdivision, thirteen overflow swales within the Newport and Ellis Landing subdivision, and eight overflow swales in The Landing Subdivision. The funds associated with the 25 swales will be requested for reallocation towards another drainage improvement project such as Main Street and Wesley Drive or Oaks of Clear Creek Drainage Improvements Ph II - North Detention Pond.

The Main Street/Wesley drainage improvements include the installation of 5’X5’ to 10’X5’ reinforced concrete boxes, 36” storm laterals, and inlets along FM 518, Wesley Street, and North Wesley Drive. The storm boxes and pipes will convey storm water up to a wing wall structure that outfalls to Corum Ditch. The existing roadway and appurtenances will be reconstructed and repaired to their original condition or better. Plans for this project have been approved and utilities are currently being relocated to accommodate the new drainage infrastructure in the right-of-way.

The Oaks for Clear Creek Drainage Improvements Ph II - North Detention Pond include construction of an approximate 60 ac-ft capacity detention facility on a 15-acre tract just north of The Oaks of Clear Creek Subdivision, accessed from State Highway 3. There will also be storm sewer improvements along Coleman Boylan Drive, Washington Street and the Interurban right-of-way. These plans are in the final stages of completion and should go out for bid by the end of 2024.
