Consider and take action on a resolution determining that land is needed for the construction and improvements associated with the SH3 at FM 518 Intersection Improvements Project (ST 2003) in the City of League City, Texas, specifically: 1) a 0.0456 acre parcel of land, 2) a 0.0042 acre parcel of land, 3) a 0.0943 acre parcel of land, 4) a 0.0770 acre parcel of land, 5) a 0.1228 acre parcel of land, 6) a 0.0594 acre parcel of land, 7) a 0.0248 acre parcel of land, 8) a 0.0092 acre parcel of land and 9) a 0.0043 acre parcel of land; and authorizing the institution of eminent domain proceedings (Executive Director of Capital Projects)
Background:
If approved, this resolution establishes the Public Necessity to acquire real property interests in certain properties, and authorizes the uses of eminent domain powers for the acquisition of real property interests in the properties.
The purpose of this project is to improve the intersection flow capacity and decrease congestion.
Project design includes:
• Addition of 230 linear feet to the existing Left Turn Lane southbound on SH 3 and conversion of an existing Thru Lane southbound SH 3 into a second Left Turn Lane, and a new Right Turn Lane to southbound SH 3 at the FM 518 intersection
• Addition of 170 linear feet to an existing Right Thru Lane on southbound SH 3 south of the FM 518 intersection and 400 linear feet to an existing Left Turn Lane on northbound SH 3 at the FM 518 intersection
• Conversion of an existing Thru Lane on northbound SH 3 into a second Left Turn Lane and a new Right Turn Lane to northbound SH 3
• Addition of 180 linear feet to the existing Left Turn Lane on eastbound FM 518 with a raised curb median and a new Right Turn Lane eastbound on FM 518
• Conversion of a Right Turn/Thru Lane to a 460 linear foot Right Turn Lane on westbound FM 518 and an addition of 110 linear feet to the Left Turn Lane on westbound FM 518
Staff have exhausted all of their negotiations with the property owners to acquire the necessary property rights for the Project. To move the project forward, Staff is asking that the City Council declare a Public Necessity for the Project and authorize staff to proceed with eminent domain proceedings.
The proposed resolution is being presented to address condemnation law procedural requirements effected by the passage of Senate Bill 18 in 2011.
