Consider and take action to amend a professional services agreement with Brown & Gay Engineers, Inc. in the amount of $63,117 for the design phase of the WW1301 30-inch Gravity Sewer on Calder Road Project (Deputy City Manager)

 

Background:

If approved, this will allow for the abandonment of the City’s Safari Mobile Home Park and Big League Dreams Lift Stations.  The overall project includes 8,580 linear feet of 30-inch sanitary sewer, 720 linear feet of 8-inch sanitary sewer to serve Weyer Street, and 2,000 linear feet of 12-inch line to serve Ervin Street and Big League Dreams.

 

Year 2004-2005:

On July 13, 2004, City Council awarded a professional services agreement (the “Agreement”) to Brown & Gay Engineers, Inc. (B&G) in the amount of $143,200 for the design of the then 24-Inch Gravity Sewer on the Calder Road Project (WW0407).  The Agreement was amended by Council actions on October 12, 2004 and January 25, 2005.  Those amendments increased the contract amount by $37,332, bringing the Agreement’s contract amount to $180,532.  B&G’s design was brought to 99% completion status in 2005.  At that time, funding was not in place for construction so the project was put on hold.

 

Year 2006-2008:

Construction unfunded - project on hold.

 

Year 2009-2010:

In August of 2009, the City and Galveston County entered into an inter-local agreement that included road improvements for Calder Road from Ervin Street to League City Parkway.  It was determined at that time that the construction phase for the sanitary sewer improvements should run concurrently with the construction of the roadway improvements.

 

Year 2011-2012:

While the sewer design portion was on hold, the City updated its Master Wastewater Plan and it was determined that the line size should be upgraded from 24-inch to 30-inch.  When funding was approved for the sewer line’s construction phase in the FY 2011 budget, staff requested that B&G provide a proposal to revise and update the 2005 design to:  (i) reflect the current topographic and ownership conditions; (ii) increase the scope of services to provide property descriptions and drawings for real property rights acquisitions; and (ii) bring the Agreement’s fee schedule in line with B&G’s current fee schedule.  The proposal submitted by B&G in the amount of $62,138 was approved by Council on January 11, 2011 as another (3rd) amendment to the Agreement, bringing the contract amount to $242,670.  Soon thereafter, staff again asked B&G to hold up on the project while the City tried to bring the Tanger Outlet to the Big League Dreams commercial area. Also in the same time frame, the City approved its Master Mobility Plan, which called for Calder Road to be a four-lane, divided boulevard section. At a public meeting held on October 25, 2012, area residents requested that the sewer project scope be increased to include the extension of lateral sewers to serve residents along Weyer Street and Ervin Street.

 

Year 2013:

On June 11, 2013, under Council Item 10F, Council approved Amendment 4 to the Agreement for B&G to revise their then- 99% plans to accommodate Council-approved right-of-way schematic changes to include a roundabout at Calder’s intersection with Turner and modified right-of-way takings.  This would upgrade the pipe size to 30-inches, and add lateral sewer lines to server Weyer and Ervin Streets.  Approved Amendment 4 resulted in a net increase of $46,606, bringing the total Agreement amount to $288,676.

 

Year 2014 (Current Request - Amendment 5):

Staff recommends that a 12-inch line be extended from the proposed 30-inch gravity line along the east side of Calder to the Big League Dreams Lift Station.  This will allow for the abandonment of the Big League Dreams Lift Station.  In addition, staff would like to split the construction of the 30-inch gravity line so that construction of the northerly section (from Butler Road and LC Parkway to Turner Road, to Calder Road) can be bid and constructed prior to the bid and construction of the southerly portion to be constructed along the east side of Calder.  That southerly portion bid and construction is being folded into the Calder Road improvement project so as to reduce overall inconvenience to residents and hopefully gain the benefit of economy of scale.  If approved, B&G will:  (i) perform additional boundary and topographic surveying to include the extension to the Big League Dreams Lift Station; (ii) add plan drawings and specifications to include the Big League Dreams line and lift station abandonment items; (iii) prepare two complete sets of construction specifications and drawings; and (iv) perform additional bid phase and construction administration phase services.  By splitting the overall project into two phases, staff anticipates that the construction of the northerly phase should be complete at approximately the same time that the southerly phase is being bid, thereby saving approximately 4-months of construction time.  If approved, Amendment 5 will result in a net increase of $63,117, bringing the total Agreement amount to $351,793.  Additional funding for these services shall be from 2012B CO Fund 126, Account 126-32210787-9010 WW1301.
