Title

Consider and take action on a resolution authorizing a Multiple Use Agreement with this Texas Department of Transportation regarding the Dr. Ned and Faye Dudney Clear Creek Nature Center Kayak Launch (PK1910B) at Highway 270 at Clear Creek  (Executive Director of Capital Projects)

 

Background:

Approval of this resolution will authorize an application for a Multiple Use Agreement with TxDOT for use of the land within the TxDOT right-of-way (ROW) upon which a portion of the planned Kayak Launch within the Dr. Ned and Faye Dudney Clear Creek Nature Center (Nature Center) is to be constructed. The resolution is required by TxDOT for the City of League City to execute a MUA with TxDOT. According to a TxDOT representative, the MUA has no expiration date but can be terminated by either the City or TxDOT or changes can be made through an amendment.

 

The planned location for this Kayak Launch, within an embayment of Clear Creek, adjacent to the FM270 turnaround, is in the Management Plan for the Nature Center. The location provides a quiet, adequately deep launching area with excellent access from FM 270. However, the planned parking area within property of the Nature Center west of the turnaround was found to contain a large wetland area. As an alternative, the City’s consultants have proposed parking for several vehicles that is parallel to the southbound lane of the loop road. The complete parking area and access sidewalk are within TxDOT right-of-way (ROW). In addition, the elevated boardwalk to access the kayak launch is partially within TxDOT ROW. TxDOT requires the MUA to allow the City to place facilities within the ROW.

 

Attachment 3 - Multiple Use Agreement Documents contains a list of Attached Exhibits required by TxDOT. When the construction plans are completed, the following required exhibits, listed within the MUA form, will be provided to TxDOT along with the required resolution that will be approved within this agenda item. For the time being, the documents described within the MUA are included as a part of the MUA and their status explained below.

-                     Exhibit A - General Layout (Subject to minor updating prior to submission to TxDOT)

-                     Exhibit B - Metes and Bounds (Will be prepared and submitted to TxDOT as part of the final application for the MUA)

-                     Exhibit C - Approved Construction Plans (90% Plans included here but will submit Final Plans to TxDOT)

-                     Exhibit E - Attachment A (FHWA Additional Requirements - Included)

 

The construction plans are nearing 100% completion, the USACE Permit has been approved, and the Texas General Land Office (GLO) has approved a lease for the kayak launching platform. As a result, staff is seeking to have the MUA Resolution approved so that the MUA can move forward with TxDOT when all other documents are available. That will allow staff to bid the project when all clearances are received.
