Consider and take action on Ordinance No. 2018-03, creating a Planned Unit Development, PUD-17-0005 (Coastal Point PUD), approximately 202.5 acres in size, generally located on the north side of East FM 646, south of League City Parkway (SH 96), east of South Shore Boulevard and west of State Highway 146 in League City, Texas - Second Reading (Director of Planning & Development)

 

Planning and Zoning Commission recommended approval, 7-0-0 with one absent, on December 4, 2017.

City Council approved the first reading, 7-0-0 with one absent, on January 23, 2018.

 

Background:

Approval of this ordinance will rezone approximately 202.5 acres to create a new Planned Unit Development (PUD).

 

On June 28, 2016, City Council adopted the Lakes of Quail Pointe as a 206.4-acre Planned Unit Development (PUD) As part of the ordinance (Ordinance No. 2016-14) creating the zoning overlay, a guiding document known as a “PUD document” was included. The PUD document includes guidance of how the subdivision will be developed along with a Conceptual Land Plan and illustrative exhibits further supporting the written portion of the document.

 

In late 2016, the Planning Department was notified that another development group had purchased the property in the Lakes of Quail Pointe PUD with the exception of approximately 3.9 acres in the northeast corner of the development. The owner of the 202.5 acres is currently requesting a new PUD since the existing PUD document cannot be amended due to the objections of the owner of the 3.9-acre tract. The five items being amended include renaming the PUD, revising the Land Use Table, not requiring roundabouts, revising the wastewater /sewer system, and reducing the acreage of the PUD.

 

Project Summary:

The proposed PUD will consist of all the regulations contained within the Lakes of Quail Pointe PUD with the five changes listed below.

 

Change #1: Rename the Development

The applicant proposes to rename the PUD from “The Lakes of Quail Pointe” to “Coastal Point”.

 

Change #2: Revise the Land Use Table

Shortly after the PUD was approved by City Council, the applicant submitted the master plan for the Lakes of Quail Pointe to be reviewed by the Development Review Committee (DRC). It was during the initial review that an error was found in the approved Land Use Table shown in Section III.B. The mathematical error is located in the acreage column. The proposed changes to the table would decrease the constraints and increase the single-family residential

by 4.3 acres. Additionally, the 3.9 acres not party to this rezoning will also be removed from the table. All other portions of the table are proposed to remain the same.

 

Change #3: Revise the Streets and Circulation System

When adopted, the street circulation system portion of the PUD document indicated that two roundabouts were required to be constructed in the northern and southern third of Madrid Lane. The applicant proposes to remove the language requiring the roundabouts within the development to allow more flexibility in the roadway network. The proposed change in language does not significantly affect the overall roadway network and the development is still required to be designed and constructed to League City’s standards. The proposed change no longer requires roundabouts, but does not prohibit them.

 

Change #4: Revise the Wastewater Collection System

One of the more detailed aspects of the Lakes of Quail Pointe PUD document relates to the wastewater collection system. The PUD was originally designed to have its wastewater treated by the nearby Bayview MUD Wastewater Treatment Plant (WWTP), located northeast of the development. Prior to the first connection to the WWTP, a series of improvements had to be made to the plant. Several months after the PUD was adopted by City Council, the applicant notified the City that the design for the Bayview MUD wastewater and water reuse were no longer financially feasible options. Since the development will not connect to the Bayview WWTP, the improvements required by the original PUD document will not be made to the plant.

 

Staff coordinated with the developer on an alternative solution to provide a direct connection into the City’s wastewater system. The proposed design will extend public sanitary sewer service south to FM 646 and then west to the City’s nearest sanitary sewer main near the intersection of FM 646 and South Shore Boulevard. This proposed revision also includes an update to Exhibit ‘M’ of the PUD document concerning the wastewater line.

 

Change #5: Revise the Acreage of the PUD

The acreage of the new PUD (202.5 acres) will be revised in the new PUD document.

 

The Coastal Point PUD will provide both access and stubbed utility lines for the residual 3.9 acres from the Lakes of Quail Pointe.

 

On December 4, 2017, the Planning and Zoning Commission held a public hearing and recommended unanimous approval of the four items, 7-0-0 with one member absent. The Planning Department mailed out 169 letters and has not received any public communications either in favor or opposed to this request. The area of the PUD request was reduced after the Planning and Zoning Commission meeting.

 

On January 23, 2018, the City Council held a public hearing and approved the first reading 7-0-0 with one member absent.

 

Staff Recommendation:

Staff recommends approval of the request for a Planned Unit Development (PUD-17-0005 - Coastal Point PUD).
