Title

Consider and take action on a resolution authorizing Amendment 4 to the Professional Services Agreement (PSA) with Burditt Consultants for the Planning and Design of the FM 270 Public Boat Ramp Renovations (PK1804) in an amount not to exceed $12,512 (Executive Director of Capital Projects)

 

Background:

Approval of this resolution will authorize Amendment 4 to the PSA with Burditt Consultants for the Planning and Design of the FM 270 Public Boat Ramp Renovations (PK1804) in an amount not to exceed $12,512. Amendment 4 when added to Amendment 2 and 3-previously approved administratively-equals $54,512, thus exceeding the City Manager approval level, requiring City Council approval.

 

Burditt Consultants (Burditt) and the City of League City (COLC) staff determined that Burditt is owed additional compensation based on a provision in the PSA that allows for an increase in the fee if the Opinion of Probable Cost (OPC) exceeds $500,000. In addition, COLC requested an updated OPC due to the time that has lapsed since the most recent OPC was provided by Burditt. The updated OPC is needed for the Boating Access Construction Grant application to the Texas Parks and Wildlife Department (TPWD) that COLC will submit soon to receive funding for the construction of this project.  This updated OPC will help the City substantiate the amount of construction grant which will be requested.  Planning and design phases of the project are completed and approved by TPWD and City was reimbursed $116,362.50 on October 3, 2025 as part of the grant for design services.     

 

The attached proposed Amendment 4 includes a fee increase of $12,512 for the following items:

-                     5% of fee for increased services in Final Design                            $2,378

-                     5% of fee for increased services in Bid/Award Phase                     $2,378

-                     10% of fee for increased services in Construction Observation      $4,756

-                     Provide up-to-date OPC as required by TPWD grant application    $3,000

Original PSA ($62,000) - Covered preliminary design, and a construction estimate to allow a grant application to be submitted to Texas Parks and Wildlife Department (TPWD) for a combination of design and construction funding.

 

Amendment 1 ($93,000) - Provided for completion of all construction documents for the Boat Ramp Renovation project.

 

 

Amendment 2 ($31,000) - Provided for Burditt to A) conduct USACE permitting support activities consistent with project goals and B) Conduct Wetland Delineation.

 

Amendment 3 ($11,000) - Provided for Burditt to conduct 1) Hydraulic Impact Analysis, 2) carry out additional design services for developing construction documents, and 3) conduct regulatory work required by USFWS for the Boating Access Grant through TPWD.

 

Staff requests City Council approval of Amendment 4 as submitted by Burditt Consultants and reviewed by staff.
