Title

Consider and take action on an ordinance updating land use assumptions and the capital improvement plan for roadway facilities and updating roadway impact fees for League City pursuant to Texas Local Government Code Chapter 395 (Executive Director of Development Services)

 

Background:

Approval of this items will update the City’s land use assumptions, adopt a capital improvement plan for Roadway Facilities and establish updated capital recovery fees for the City’s roadway network. In accordance with Chapter 395 of the Texas Local Government Code, upon the adoption of updated land use assumptions and capital improvements plan, the City must adopt an ordinance setting a public hearing to discuss the revision of a Roadway Capital Recovery Fee (Council set October 22nd as date in September 10th Council Meeting). State law allows and regulates cities to collect roadway capital recovery fees in accordance with Chapter 395 of the Texas Local Government Code. As part of this Chapter, the City is allowed to set Capital Recovery Fees (CRFs) at any level up to the maximum as determined in the “2024 League City Roadway Capital Recovery Fee Final Report” Study as prepared by the City’s consultant team of Freese and Nichols and NewGen Strategies & Solutions.

 

Chapter 395 requires that the land use assumptions and capital improvements plan for which CRFs are imposed shall be reviewed, evaluated, and updated every five years. The last study was conducted in 2018 and approved by City Council under Ordinance 2019-01 in January 2019 with City Council electing to adjust fees in September 2021 (Ordinance 2021-32). The 2021 fee adjustment was to increase certain fees that were set below the maximum fee established with Ordinance 2019-01.

 

Attached is a table illustrating the difference for several types of developments between the City’s current rates and the rates now being proposed through the CIAC.

 

Staff recommends approval of the proposed Roadway Capital Improvement Plan and Roadway Capital Recovery Fees as presented and would further recommend the following for implementation of said fees:

 

                     Developments that have the final plat recorded on or before March 31, 2024, shall be required to pay the Roadway Capital Recovery Fees as currently imposed.
                     Developments that have the final plat recorded on or after April 1, 2024, shall be assessed Roadway Capital Recovery Fees based on the updated study.
