Consider and take action on acceptance of three (3) “Utility Conveyance and Security Agreement(s)” with Galveston County Municipal Utility District No. 46 for water, sanitary sewer, and drainage facilities associated with the development of Mar Bella, Section 11B; Mar Bella, Section 16A; and Mar Bella East Collector Road (Isla Vista Drive) (Deputy City Manager)
Background:
If approved, the City will be accepting the Galveston County Municipal Utility District No. 46 (the “District’s”) formal conveyance for the water, sanitary sewer, and drainage facilities associated with the following developments: Mar Bella Section 11B; Mar Bella Section 16A and Mar Bella East Collector Road (Isla Vista Drive).
This action is in conformance with the Utility Agreement by and between the City, the District and Grason Communities, Ltd. (Ordinance 2003-71). The Utility Agreement requires that these facilities be conveyed to the City for ownership, operation and maintenance subject to a security interest retained by the District.
Subject to applicable warranties, the facilities being conveyed were accepted for City operation and maintenance in accordance with the following table:
