Consider and take action on a resolution authorizing a variance to Chapter 10 of the City of League City Code of Ordinances, to allow a restaurant located at 3729 East League City Parkway, League City, Texas that is less than 300 feet from the property line of a day care to serve alcohol (City Secretary)
Background:
Approval of this item will authorize a variance to allow a restaurant (Tokyco Bao) located at 3729 East League City Parkway, League City, Texas that is less than 300 feet from the property line of a day care to serve alcohol.
Per League City Code of Ordinances Section 10-1. Minimum distance of places of sale from church, hospital, public school or daycare center. It shall be unlawful for any person to sell or engage in the business of selling intoxicating liquor or beer within the city where the place of business of such person is situated within 300 feet of a church, public school, public hospital or daycare center.
Based on the distance measurements prepared by City staff indicating that the boundary of the leased suite is approximately 195 feet from a daycare center, the location does not meet the separation requirements of Chapter 10 of the City Code and therefore requires City Council approval of a variance before certification may be issued.
The applicant provided an email communication from the owner of The Learning Experience-Academy of Early Education indicating they do not oppose the variance.
