Consider and take action on an ordinance amending Chapter 46, Section 46-104 of the Code of Ordinances of the City of League City, entitled “Food Booths and Food Vendors,” to update regulations governing mobile food vendors and food booths (Fire Chief)
Background:
Approval of this item will authorize an amendment to Section 46-104 of the Code of Ordinances regarding food booths and food vendors.
This amendment is necessary to align City regulations with House Bill 2844, adopted by the 89th Texas Legislature, which transferred permitting authority for mobile food vendors to the State of Texas effective July 1, 2026. As a result, the City may no longer require a City-issued mobile food vendor permit.
The proposed ordinance removes the City’s mobile food vendor permit requirement and related local permit provisions. The amendment also updates of update some language and preserves the City’s fire protection, life safety, fuel, gas container, location, access, and emergency egress requirements applicable to food booths and food vending vehicles. These changes are intended to maintain public safety standards while ensuring the City’s regulations are consistent with state law.
