Consider and take action on an ordinance amending Chapter 125, Section 5.9 of the Code of Ordinances of the City of League City entitled, “Improvement plans and acceptance of the subdivision improvements” regarding streetlight ownership on public roadways within the City (Executive Director of Development Services)

Background:
Approval of this item will amend Chapter 125, Section 5.9 of the Code of Ordinances of the City of League City. This chapter contains the requirements for design and construction of public improvements.
This ordinance was last updated in 2022 (Ordinance 2022-25). The amendment provides the following changes below:
· Sec. 125-5.9.3(b): This is a new note that provides for City ownership of streetlights within public roadways. Changes to remove specific structure and equipment pad elevation requirements from Chapter 22, and instead to reference Chapter 50 the “Flood Ordinance” for these requirements.
· Sec. 125-5.9.3(c): Modification to call out streetlights when referencing applicant cost responsibilities.
· Sec. 125-5.9.3(h): Updating requirements for submittals to the City to require electronic submittals. Staff has been accepting electronic submittals since 2021, but the ordinance was not updated at that time for this change. Item 2 in this section was also updated to clearly note the need for survey work to tie back to City maintained benchmarks.
· Sec. 125-5.9.5: Modification of text to clearly reference all City criterion.
This ordinance revision will allow for the approximately 125 new LED streetlights installed in League City each year to be owned by League City instead of the electrical providers. This change in ownership is estimated to save the City approximately $25.57/pole/month going forward (based on TNMP tariffs vs. city owned rates).
Staff recommends approval of this amending ordinance and requests a first and final reading.
