Consider and take action on an ordinance establishing Chapter 56, entitled “Healthy Spaces,” of the Code of Ordinances to adopt regulations governing camping on public and private property (Mayor Long)

Background:
Approval of this item will establish a new Chapter 56 of the Code of Ordinances entitled “Healthy Spaces.” The ordinance is intended to address recent complaints regarding unauthorized camping, habitation, and sheltering activities occurring in and around the City.
The proposed ordinance would require authorization for camping on public or private property. Camping at authorized campgrounds, recreational vehicle parks, and temporary recreational camping on residential property (like backyard camping) would continue to be permitted under the ordinance.
The ordinance is intended to provide law enforcement with additional tools to address unauthorized camping activities while focusing on voluntary compliance whenever possible. Before issuing a citation, peace officers would generally be required to provide an opportunity to vacate the property and, when reasonably available, provide information regarding lawful camping locations or available services.
The ordinance also establishes definitions, authorization requirements, enforcement procedures, and penalties for violations.
