Consider and take action on a resolution authorizing an agreement for the purchase of electricity from TXU Energy Retail Company LLC for The Ballpark at League City (City Attorney)
Background:
Approval of this resolution will authorize the City Manager to execute a contract for the purchase of electricity with TXU Energy Retail Company LLC (TXU) for The Ballpark at League City. Under Texas Government Code 252.022 (15) the City is exempt from normal competitive purchasing requirements for the purchase of electricity.
In 2018, the City entered into an agreement with TXU for the purchase of energy for all of the City's facilities at that time. When the City assumed management of The Ballpark at League City, it was necessary for the City to arrange for sufficient electricity to run the facility. TXU offered the City a separate energy agreement for The Ballpark that will run concurrently with the City's 2018 TXU agreement.
The 2018 TXU contract rate for all City facilities is $0.0384/kWh. The TXU rate for The Ballpark at League City will be $0.0756/kWh. Both agreements will expire on October 31, 2028.

FUNDING
{X} Funds are available from The Ballpark at League City fund. Expenses will be posted to Utilities - Electric account 23254610-53500. The FY24 budget for The Ballpark will be addressed in the 2nd Quarter budget amendment.
