Consider and take action on a resolution authorizing an encroachment agreement with Genesis Pipeline Texas LP, for the City's benefit that allows the City to install an earthen berm from south of the Washington Street and FM 3 intersection to Bradshaw Ditch within the existing Genesis Pipeline easement for an amount not to exceed $3,500 (Director of Engineering)
Background:
If approved, this resolution for a Consent to Encroach Agreement will allow the City to have an earthen berm, approximately three feet (3’) in height, constructed over an existing Genesis Pipeline easement. This berm is needed to help mitigated the potential for flooding within the Oaks of Clear Creek Subdivision.
As part of this process, Genesis Pipeline has a $3,500 application fee. Once the Consent to Encroach is executed and required application has been submitted, Genesis will begin their review. The City can not start any construction activities until this process has been completed. It is anticipated that the cost to build the earthen berm as shown on attached documents will be approximately $18,205.
