Background:
If approved, this resolution establishes the Public Necessity to acquire real property interests in certain properties, and authorizes the uses of eminent domain powers, if necessary, for the acquisition of real property interests in the properties.

The installation of the soundwall project was identified in TxDOT’s environment study as being beneficial to reduce IH 45 traffic noise volume and was accepted by the Clear Creek Village property owners. TxDOT will design and install the soundwall, but City is to acquire easements and relocate existing franchise utilities within City’s jurisdiction prior to the construction of TxDOT’s sound wall. The proposed 14-foot sound wall for the Clear Creek Village subdivision is a collaborative effort between the City of League City, Galveston County, Clear Creek residents, and TxDOT.

To secure these TCE’s in a timely manner to assure TxDOT that City has all the easements, staff is requesting that City Council declare a Public Necessity for these parcels while negotiations and offers are being made and authorize staff to proceed with eminent domain proceedings, if necessary, for the above-mentioned parcels.

The proposed resolution is being presented to address condemnation law procedural requirements effected by the passage of Senate Bill 18 in 2011.
