Consider and take action on a resolution authorizing a Feasibility Study cost share agreement with US Army Corps of Engineers through the Continuing Authorities Program (CAP 205) in support of the Clear Creek - (DR 18) FM 270 Bypass Channel Project for an amount not to exceed $625,788.25 (Executive Director of Capital Projects)
Background:
Approval of this resolution will authorize the City Manager to enter into a Feasibility Study cost share agreement, including additional support documents (Certificate of Authority, Lobbying Certification and Financial Certification), with the US Army Corps of Engineers (USACE) for the FM 270 Bypass Channel Project.
The Continuing Authorities Program, Section 205 (CAP 205), applies to small scale flood mitigation projects with a maximum federal expenditure of $10 million. An overview fact sheet is attached which shows the project breakdown for cost sharing between federal and nonfederal sponsors.
This project was identified in the Lower Clear Creek and Dickinson Bayou Regional Drainage Study that was completed in 2021. USACE staff helped identify this project as a good candidate for the CAP 205 program which got approval for a FID (Federal Interest Determination) this year. With acceptance of the FID, they are now ready to move into the Feasibility Study phase which will determine if the benefit of the project is justification for the federal government to fund design/construction.
The current estimate of Feasibility Study cost by USACE is $1,228,705.90 plus a 10% contingency for a total of $1,351,576.49. The federal government covers the initial $100k and everything over that amount is shared 50/50. This places a max share of $625,788.25 on League City. USACE performs all work required for the study without need for City staff/consultants to be involved.
