Consider and take action on a resolution approving the utility conveyance and security agreement with Galveston County Municipal Utility District No. 36 for water, sanitary sewer, paving and drainage facilities associated with the Westland Ranch Subdivision, Section 7 and Muldoon Parkway, Phase 2 (Executive Director of Development Services)

 

Background:

Approval of this resolution will approve utility conveyances and security agreements with Galveston County Municipal Utility District No. 36 (the “District”) for the Westland Ranch Subdivision, Section 7 and Muldoon Parkway, Phase 2.

 

The District has constructed certain water, sanitary sewer, street and drainage facilities and is formally conveying the facilities to the City pursuant to the Utility Agreement, by and between the City and the District (Ordinance No. 2018-09). In Article 1, Section 1.04.d of the Utility Agreement, it is noted that the City shall "accept conveyances, as provided for herein, of the completed integral stages of the System (except for parks and recreational facilities and storm water detention facilities), which have been acquired or constructed by the District". Subject to a security interest retained by the District, the agreement requires that these facilities be conveyed to the City for ownership, operations and maintenance.

 

The municipal infrastructure for the development was accepted by the City on the following date:
