Consider and take action on a resolution authorizing a license agreement with T-Mobile West LLC, for the placement of antennas and related equipment at the Candlewood Water Tower located at 5123 1/5 Candlewood Drive (Director of Planning)
Background:
Approval of this resolution will create a new license agreement for the placement of antenna and associated equipment on the existing water tower located at 5123 1/5 Candlewood Drive. The term for the cell tower license agreement is for 60 months and is subject to two renewal terms of 60 months each. Starting on the first day of the initial term, and on a set day of every month thereafter, T-Mobile, will pay in advance a monthly licensing fee of $3,200. Commencing one year from signature, the license fee will be automatically increased annually by three percent (3%) of the then current license fee. The City has four similar agreements currently in place ranging in value from $1,890.75 to $3,120 per month.
The total revenue generated for the City over the course of this 5-year agreement is $206,213. Should the two additional terms be renewed, the total revenue generated will be $775,124.
The City may terminate the License Agreement at any time by giving T-Mobile West, LLC, at least 180 days prior written notice for the termination without default and 60 days written notice with default.
The City Attorney’s Office and Director of Public Works have reviewed and approved the agreement.
