Consider and take action on an ordinance amending Chapter 42, Article II of the Code of Ordinances of the City of League City relating to noise, clarifying exemptions, establishing a special event sound permit process and updating enforcement provisions (Mayor Long, Councilmember Chadwell, and Councilmember Tressler)

 

Background:

Approval of this ordinance updates Chapter 42, Article II (Noise Ordinance) related to unreasonable noise, clarifies certain definitions, creates a special event sound permit process, and updates penalty provisions for enforcement.

 

Summary of Major Changes:

                     Keeps the rule that unreasonable noise is not allowed in the City.

                     Says that loud amplified sound in a neighborhood after 7:00 p.m. is presumed to be too loud.

                     Removes extra definitions to make the rules easier to read.

                     Lists clear exemptions where noise is allowed, so people will not be ticketed in those cases.

                     States that the City does not need a permit for its own events.

                     Allows golf courses to start mowing at 5:30 a.m. without breaking the rules.

                     Creates a permit process for special events, with decisions made by the Police Chief and appeals to the City Manager.

                     Updates penalties so they match the City’s general penalty rules.

                     Confirms that unreasonable noise is not allowed unless it falls under an exemption or has a special event sound permit.

                     Allows noise from emergency generators during power outages and during maintenance of the generators
