Background:

Approval of this item will direct staff to utilize competitive sealed bidding for any solicitation that is projected to exceed $100,000 and raise the City Manager’s signature authority to $100,000.

 

This item is being presented in response to the recent passage of Senate Bill 1173. Senate Bill 1173 amended Section 252.021(a) of the Local Government Code, increasing the competitive procurement threshold for local governments from more than $50,000 to more than $100,000.

 

Prior to Senate Bill 1173, local governments were required to use a competitive procurement process for purchases exceeding $50,000. That threshold had remained unchanged since 2007, even as the costs of goods and services increased substantially.  The new threshold took effect on September 1, 2025; however, the City’s internal purchasing policy still reflects the previous $50,000 limit.  The amendment updates the threshold to align with the new state authorized limits and more accurately reflect present-day purchasing costs.
