Consider and take action on a resolution approving utility conveyance and security agreements with Galveston County Municipal Utility District No. 36 for water and sanitary sewer facilities associated with Westland Ranch Subdivision Section 2 (Executive Director of Development Services)

 

Background:

Approval of this resolution will approve utility conveyances and security agreements with Galveston County Municipal Utility District No. 36’s (the “District’s”) for the following:  Westland Ranch Subdivision Section 2.

 

The District has constructed certain water, sanitary sewer, drainage, and paving facilities and is formally conveying the facilities to the City pursuant to the Utility Agreement, by and between the City, the District, and Forestar (USA) Real Estate Group, Inc., approved on April 24, 2018, by Ordinance #2018-09. Subject to a security interest retained by the District, the agreement requires that these facilities be conveyed to the City for ownership, operations and maintenance. 

 

The City will not own the constructed detention ponds or channels under the jurisdiction of the Galveston County Consolidated Drainage District.
