Consider and take action on a request for Consent to Encroach for a proposed private swimming pool apron and concrete flatwork improvements at 6152 Darlington Court, within a dedicated 8-foot utility easement on Lot 1, Block 2, Westover Park, Section 3 (Deputy City Manager)
Background:
If approved, this Consent to Encroach will allow the home owner to place a swimming pool apron and concrete flatwork within an existing dedicated 8-foot wide utility easement.
The encroachment onto the easement will be approximately one (1) feet in width by approximately fifty-five (55) feet in length. The depth of the encroachment would be no more than 12-inches deep, measured from natural ground elevation.
The home owner will be responsible for obtaining consent from the City’s franchised utilities and submitting such consent as part of the Building Permit application. Any relocation of franchised utilities infrastructure or service lines will be at the sole cost of the home owner.
Attached, please find a Google Earth aerial location map and the proposed Consent to Encroach document that would be executed and filed in County Clerk’s office. Sketches showing the general locations of the proposed encroachments are attached as Exhibit “A” to the Consent to Encroach document.
The City will not be giving up any of its rights. The home owner and home owner’s successor(s) in title of the subject property will be responsible for installation and maintenance of all of the improvements proposed to be installed. Should the City, for any reason, have to damage the encroaching improvements in association with the construction or maintenance of City infrastructure within the dedicated easement, the home owner or home owner’s successor(s) in title will be responsible for the repairs to the damaged encroaching improvements.
