Title

Consider and take action on a resolution appointing the Planning & Zoning Commission (P&Z) as the Citizen Improvement Advisory Committee (CIAC) in relation to the City’s 2024 Master Mobility Plan and Roadway Capital Recovery Fee Update (Executive Director of Development Services)

 

Background:

A Citizen Improvement Advisory Committee (CIAC) is required under Texas Local Government Code Section 395.058 for the adoption of Capital Recovery Fees. The Texas Local Government Code Section 395.058 outlines the requirements for establishing a CIAC. As per the statute, the CIAC composition must include at least 40% of members representing real estate, development, or building industries, excluding government officials.

The Transportation Infrastructure Committee, as currently seated, no longer complies with Texas Local Government Code Section 395.058. The existing structure of the Planning & Zoning Commission (P&Z) positions them well to effectively fulfill this role. They also possess relevant expertise in land use and development, areas directly impacting Capital Recovery Fees. It is therefore recommended, for the purpose of ensuring compliance with the statute's composition requirements, that the P&Z Commission be appointed as the CIAC.

Approval of this resolution will appoint the current P&Z Commission as the CIAC in accordance with the Texas Local Government Code Section 395.058.
