Consider and take action on an ordinance amending Section 70-123, entitled “Restriction on Outdoor Donation Bins,” of Article VI, Chapter 70 of the Code of Ordinances of the City of League City, to clarify the application of the City’s donation bin regulations to property owned, leased, or operated by governmental entities (Mayor Long)
Background:
Approval of this item will amend Section 70-123 of the Code of Ordinances to clarify that the City’s donation bin regulations do not apply to donation bins located on property owned, leased, or operated by governmental entities, provided the governmental entity approves the placement.
The City’s current rules generally limit where outdoor donation bins may be placed. The proposed amendment clarifies that those rules do not apply to donation bins placed on property owned, leased, or operated by a governmental entity, as long as the governmental entity approves the placement.
Governmental properties are actively managed and maintained by public agencies and are subject to their own oversight and operational controls. This oversight eliminates the concerns associated with unattended donation bins on private property.
Examples may include donation bins placed on school district property as part of a school-sponsored collection program, or similar donation programs located on property controlled by another governmental entity.
Donation bins located in a public right-of-way would still be subject to the City’s donation bin regulations.
