Consider and take action on a resolution determining that land is needed for the construction and improvements associated with the Clear Creek Village Soundwall Project (ST2202), in the City of League City, Texas, specifically: 1) Parcel 32- a 0.0094 acre parcel of land as easement, and 0.0141 acre parcel of land as temporary construction easement believed to be owned by C.J. Mitchell 2) Parcel 33- a 0.0144 acre parcel of land as easement and 0.0264 acre parcel of land as temporary construction easement believed to be owned by 713 RE, LLC; and authorizing the institution of eminent domain proceedings (Executive Director of Capital Projects)
Background:
If approved, this resolution establishes the Public Necessity to acquire real property interests in certain properties, and authorizes the uses of eminent domain powers, if necessary, for the acquisition of real property interests in the properties.
The installation of the soundwall project was identified in TxDOT’s environment study as being beneficial to reduce IH 45 traffic noise volume and was accepted by the Clear Creek Village property owners. TxDOT will design and install the soundwall, but City is to acquire easements and relocate existing franchise utilities prior to the construction of TxDOT’s sound wall. The proposed 14-foot sound wall for the Clear Creek Village subdivision is a collaborative effort between the City of League City, Galveston County, Clear Creek residents, and TxDOT.
To move the project forward, staff is requesting that City Council declare a Public Necessity for the Project and authorize staff to proceed with eminent domain proceedings, if necessary, for the above 2 parcels.
The proposed resolution is being presented to address condemnation law procedural requirements effected by the passage of Senate Bill 18 in 2011.
