Background:
Approval of this resolution with approve a Real Property Interests Exchange Agreement with MB Harbour, Ltd. for the City’s abandonment, vacation, and release of an existing 10-foot wide utility easement in exchange for MB Harbour, Ltd.’s dedication of a 10-foot wide utility easement of equal or greater value.

In 1951, by the plat of Glen Cove Park subdivision, a 10-foot wide utility easement was dedicated across and along the rear (westerly) property line of Lots 1, 2 and 3, Block A, of Glen Cover Park. MB Harbour subsequently obtained fee simple title to those three residential lots, which were later (2009) included within the boundaries and became a part of Lot 1, Block 1, Cypress Bay, Section 2. The public’s abandonment, vacation, and release of that existing 10-foot wide public utility easement was not properly addressed with the filing of the plat of Cypress Bay, Section 2. MB Harbour is replatting the subject property as Skippers Port, splitting the one lot into two. The approval of the Real Property Exchange Agreement and the subsequent filing of the plat of Skippers Port will put into effect the City’s abandonment, vacation, and release of the existing easement and MB Harbour’s dedication of a “new” easement of equal or great value.
