Consider and take action to rescind amendments to the South Shore Harbour Master Plan related to Beacon Island as approved by the Planning & Zoning Commission in 2012 and 2013. (Mayor Paulissen)

Background:
If approved, this item will void actions taken by the Planning & Zoning Commission in 2012 and 2013 related to Beacon Island, leaving development to work within the limits of amendments to the South Shore Harbour Master Plan approved in 2009.

This item is placed on the agenda in response to requests by residents surrounding Beacon Island that are concerned with development on the island as approved by the Planning & Zoning Commission since 2013.

Approval of this item will result in the following:
· Total density approved for the site will consist of 784 total units (compared with the 850 currently approved).
· The developer may elect to construct 640 multifamily units that may be condominiums or apartments compared to 686 units currently permitted (while the plan specifies condominiums, the code does not differentiate based upon tenure).
· Remaining units will be single family and consist of a maximum of 126 townhomes and 18 residential estate lots (the current proposal consists of 95 townhomes and 69 patio homes).
· Height requirements are dictated by the 1999 ordinance.
· There will be no design standards beyond what is required by the 1999 ordinance.
· Informal agreements (formal agreements are pending) with the developer to forgive $1.2 million owed by the city for water and wastewater infrastructure (inherited from acquisition of debt and obligations of Municipal Utility District #2 when the MUD was disbanded) will be nullified.

Should a majority of Council be interested in supporting this proposal the City Attorney recommends briefly convening to executive session to receive legal advice concerning the potential ramifications of an affirmative vote.
