Consider and take action on acceptance of two "Utility Conveyance and Security Agreement(s)" with Galveston County Municipal Utility District No. 39 for water, sanitary sewer, and drainage facilities associated with the following developments: (1) Westover Park, Sections 11C and 14B; and (2) the Magnolia Creek Channel Extension (Deputy City Manager)
Background:
Approval of this item, will allow the City to accept the Galveston County Municipal Utility District No. 39's (the "District's") formal conveyance of the water, sanitary sewer, and drainage facilities associated with the following developments: (1) Westover Park, Sections 11C and 14B; and (2) the Magnolia Creek Channel Extension.
This action is in conformance with the Utility Agreement (the "MUD 39 Agreement") by and between the City, the District, and Cypress Realty, Inc. This item was approved under Resolution 2000-28 which requires that these facilities be conveyed to the City for ownership, operation and maintenance subject to a security interest retained by the District.
Subject to applicable one year warranties, the facilities being conveyed to the City were accepted for City operation and maintenance as follows:
