Consider and take action on acceptance of a "Utility Conveyance and Security Agreement" with Galveston County Municipal Utility District No. 46 for water, wastewater, and drainage facilities to serve Mar Bella, Section 15C (Deputy City Manager)
Background:
Galveston County Municipal Utility District No. 46 (the "District") has constructed certain water, wastewater, and drainage facilities in association with the development of Mar Bella, Section 15C, and is formally conveying the facilities to the City in accordance with the requirements set forth in the Utility Agreement by and between the between the City, the District and Grason Communities LTD. (Ordinance No. 2003-71); the Agreement requires that these facilities be conveyed to the City for ownership, operation and maintenance, subject to a security interest retained by the District.
The infrastructure was accepted into the City's system for maintenance and operation under Agenda Item 11D on November 18, 2014.
