Consider and take action on a resolution authorizing the renewal of a lease agreement with the Butler Longhorn Museum for use of the museum facility located at 1220 Coryell, League City, Texas (Director of Parks & Cultural Services)
Background:
Approval of this item will establish a new lease renewal agreement with the Butler Longhorn Museum (BLM) under which the museum occupies City facilities at Heritage Park. The current agreement is to expire August 31, 2016.
The proposed agreement reflects changes made after discussions between museum representatives and City Staff. As drafted, the agreement carries forward all existing terms and conditions from the existing agreement (i.e. insurance requirements, financial statements, etc.). At the request of BLM representatives, the proposal also includes waiver of utility costs. Regarding duration, the proposed renewal identifies an initial three-year term that runs from August 31, 2016 through August 31, 2019, with the current monthly rent of $100 maintained through that period of time. Also included is a renewal term, both contingent upon mutual agreement of the City and the museum and also requiring that the BLM not be in default on any provision of the agreement. After the first three-year term, the agreement includes language providing for a second three-year renewal to run through August 31, 2022.
The Lease shall automatically renew for one additional three (3) year term (the “Renewal Term”), which shall commence on the Expiration Date of Initial Term, unless the City elects to terminate the Lease at the end of the Initial Term. If the City elects to terminate the Lease at the end of the Initial Term, the City must notify BLM in writing, via mail or electronically, at least ninety (90) days before the expiration of the Initial Term that it does not wish to renew the Lease.
