Consider and take action on an ordinance authorizing an Interlocal Agreement to adjust the boundaries between the City of League City, Texas and the City of Friendswood, Texas (Director of Planning and Development)
Background:
Approval of the item would adjust the common city limits boundary between the City of League City and the City of Friendswood in the northwest corner of the City. Under Section 43.031 of the Texas Local Government Code, adjacent cities are permitted to make mutually agreeable changes to their boundaries of areas that are less than 1000 feet in width.
Project Timeline:
• February 22, 2016 - A prospective buyer initially contacted staff regarding questions related to an undeveloped tract of land and its relation to the surrounding development on 3 sides which consist of the Lakes of San Joaquin gated neighborhood located in the City of Friendswood.
• April 4, 2016 - The prospective buyers, Mr. Caudill and Mr. Titzman purchased the 4.4635-acre property.
• August 26, 2016 - A plat, The Lakes at San Joaquin, Section 3, was recorded with the Galveston County Clerk’s Office after approval by the League City Planning and Zoning Commission. The plat subdivided 1 tract into three (3) residential lots.
• October 3, 2016 - The City Council of Friendswood approved the first reading of an ordinance approving the interlocal agreement with the City of League City to adjust the city limit boundaries.
• October 25, 2016 - City Council is scheduled to consider the first reading of the ordinance approving the interlocal agreement.
• November 7, 2016 -The City Council of Friendswood is scheduled to consider the second reading of the ordinance.
• November 8, 2016 -If approved on first reading, City Council is scheduled to consider the second reading of the ordinance.
Project Summary:
The attached zoning map shows the proposed property’s relation to the city limits between the City of League City and the City of Friendswood. The boundary adjustment is limited to the three (3) platted tracts whereby the new city limit line for the City of League City would be the southern boundary line of the properties. While the City of League City does not have utility service to this area, the City of Friendswood has identified that they have sufficient capacity to serve the tracts. In addition, the adjoining neighborhood association, the Lakes at San Joaquin Homeowners Association, provided a letter indicating the intent to have the properties annexed into their HOA in which access to the properties will be provided via private streets.
Staff Recommendation:
Given (1) that the request would not significantly reduce League City’s tax base, (2) the need for the efficient and practical delivery of municipal services including police and fire, and (3) that the adjustment would provide a more logical boundary between the two cities considering the proposed development, staff recommends approval.
