Consider and take action on a resolution to approve a Standard Utility Agreement with the Texas Department of Transportation (TxDOT) for the relocation and reimbursement of City-owned water and wastewater facilities in conflict with the IH-45 South expansion project [TxDOT Project No. CSJ 0500-04-096; limits: from 0.45 miles South of FM 518 to North of FM 517] (Deputy City Manager)
Background:
Approval of this resolution will authorize a Standard Utility Agreement with TxDOT for the relocation and reimbursement of City-owned water and wastewater facilities in conflict with the IH-45 South expansion project [TxDOT Project No. CSJ 0500-04-096; limits: from 0.45 miles South of FM 518 to North of FM 517].
This federally funded project is to widen IH 45 to eight main lanes and two 2-lane frontage roads. TxDOT opened bids in October, 2016 for this 3.4 mile section of roadway and is making “fast-track” arrangements with the local utility providers for the relocations and adjustments of the utilities along the project route. TxDOT has contracted with HDR Engineers, Inc. to prepare utility adjustment/relocation plans for the section through League City. To the extent possible, the City’s facilities will remain in place. The State will pay the City the costs incurred in adjustments, removals, and/or relocations up to the amount eligible for State participation.
Per the Agreement, the City will be quit-claiming any easement interests the City has in the rights-of-way parcels being purchased in fee by the State for the widening. As this is a federally funded project, the costs for future relocations of City utilities remaining within the new IH 45 right-of-way will qualify for reimbursement, absent any changes in federal law.
