Consider and take action on a resolution approving an amendment to the professional services agreement with RPS Klotz Associates (formerly Klotz Associates, Inc.) for Five Corners Realignment Project (ST1101) to add supplemental services in an amount not to exceed $79,327.50 (Director of Public Works)

 

Background:

Approval of this resolution will authorize RPS Klotz Associates (RPS) to perform additional design and construction phase services related to the Five Corners Realignment Project (the “Project”).  The additional design services will yield operational improvements to the traffic efficiency of the project.

 

In 2016, the City of League City (City) commissioned Kimley Horn and Associates (KHA) to model the traffic operation of the project as originally designed by RPS.  The City also asked KHA to model the traffic operations of a geometrically modified version of the project.  Subsequently a side by side comparison of the traffic operations shows that from an operational perspective the modified version of the project is superior to the one originally proposed. 

 

Three supplemental change orders have transpired on this project.  The first was authorized administratively because at the time the change order totals fell under the $50,000 threshold.  This resolution will authorize the second and third supplemental change orders.  The second supplemental change order is for plan changes and corrections associated with the reconciliation of two  different survey datums, while the third is for the design changes associated the geometric modifications supporting the operational improvements highlighted above. 

 

The three supplemental change orders for this project are as follows:

Change Order #1:  The Project began in 2011 as a local street project being designed by Occam Engineering.  In 2012, the City entered into an Advance Funding Agreement with TxDOT, in essence changing the scope of the project and making it a TxDOT project.  Said change in project scope resulted in the termination of Occam Engineering and the hiring of RPS Klotz and Associates in 2014.  In 2015, Klotz, was authorized to perform supplemental services by adding the design of a multi-use path to the project and provide for additional public meetings mandated by TxDOT.

Change Order #2:   In 2016, it was determined that the necessary conversion of the survey controls from the local to the TxDOT datum, a requirement of TxDOT projects, was absent from the Klotz contract.  This change order effectuated the conversion. 

Change Order #3:  In 2017, minor design modifications are identified to improve the resulting operational efficiency of the project over that which was originally proposed.  This change order will effectuate the design modifications.

Staff respectfully requests council approve this resolution for:  (i) supplemental #2 in the not to exceed amount of $49,883.75 for services not included in RPS Klotz’ contract, but performed by them in good faith to move the Project forward and add construction phase services; and (ii) Supplemental #3 in the not to exceed amount of $29,443.75 for the plan revision and management services to accomplish the improved-efficiency re-design.  The total combined amount for both Supplemental #2 and #3 is $79,327.50, bringing this Project design contract amount to $346,061.25.
