Consider and direct staff to work with the Butler Longhorn Museum to develop a contract amendment per direction received by the City Council (Mayor Hallisey and Council Member Millican)

 

Background:

Approval of this item will allow staff to work with the Butler Longhorn Museum on a contract as per direction given during the February 27, work session and at the February 28, City Council meeting.

 

A new lease renewal agreement  with  the  Butler  Longhorn  Museum (BLM) under which the museum occupies City facilities  at  Heritage  Park was approved on August 23, 2016.

 

The agreement included all existing terms and conditions from the previous agreement  (i.e.  insurance  requirements,  financial  statements,  etc.).  At  the  request   of   BLM representatives, the proposal also includes waiver of utility costs, which was approved. The current contract is an initial three-year term that  runs  from  August  31,  2016 through  August  31,  2019, with the monthly rent of $100 maintained through that period  of  time.  Also  included  is  a renewal term, both contingent upon mutual  agreement  of  the  City  and  the  museum  and  also  requiring that the BLM not be in default on any provision of the agreement. After the  first  three-year  term,  the agreement includes language providing for a second three-year renewal to run through August 31, 2022.

 

The Lease shall automatically renew for one additional three (3) year term (the “Renewal Term”), which shall commence on the Expiration Date of Initial Term, unless the City elects to terminate the Lease at the end of the Initial Term. If the City elects to terminate the Lease at the end of the Initial Term, the City must notify BLM in writing, via mail or electronically, at least ninety (90) days before the expiration of the Initial Term that it does not wish to renew the Lease.
