Title

Consider and take action on a resolution authorizing an Advance Funding Agreement (AFA) for a Transportation Alternatives Program Project with the State of Texas through the Texas Department of Transportation for the FM 518 Bypass Hike & Bike Trail Project (TxDOT CSJ: 0976-03-104) and payment by the City in an amount not to exceed $1,048,800 (Director of Public Works)

 

Background:                     

This project will design and construct a 10-foot-wide shared use path at several locations totaling approximately 2.3 miles in length, in League City. The path will begin at FM 270 and travel east to the existing shared use path north of FM 2094 and includes a bridge over Robinson Bayou. The project will also construct a 10' wide shared use path parallel to the Hot Water Canal between Davis Street and South Shore Blvd. as well as a connection to FM 518 and in front of the Clear Creek Intermediate school. An ADA accessible path will be included along the east side of FM 2094 from FM 270 to FM 518.

 

On February 25, 2016 the Texas Transportation Commission awarded funding for this project as part of the 2015 Transportation Alternatives Program Call of the Houston-Galveston Area Council.   Approval of his  AFA would result in this project becoming an 80 %  Federal  - 20% City cost share project, thus releasing some previously committed city 4B funds for use on other projects at the discretion of the City Council.  Prior to this AFA, the City was, as part of the FY2017 approved budget, slated to invest $1,493,909 of 4B funds toward the completion of this project.  As can be seen from the table below, this AFA obligates the City to $1,048,800 toward this project. The federal share is capped, any cost overruns will be the City’s responsibility.

 

This AFA calls for an 80% Federal - 20% City cost share project, with the cost estimates and shares as follows:

If approved, the City’s first payment of $20,200 is due to the State within 30 days of execution of the Agreement, and the City’s second payment will be due to the State within 60 days prior to the construction contract being advertised for bids.
