Consider and take action on a resolution to rescind the existing lease agreement and authorizing the City Manager to execute an operating agreement with the Butler Longhorn Museum for the periods May 1, 2017 through September 30, 2017 and fiscal years 2018-2021 (Director of Parks and Cultural Services)

Background:
Approval of this item will rescind the existing lease agreement approved by City Council on August 23, 2016 and establish an operating agreement through September 30, 2021.

The agreement will allow the Butler Longhorn Museum (BLM) to continue as a unique cultural destination in League City. The proposed operating agreement replicates some terms and conditions from the previous agreement (i.e., insurance requirements, financial statements, etc.). The BLM will submit budget information no later than June 1, of each year. The initial term of the agreement is for the period May 1, 2017 through September 30, 2018. Thereafter, the agreement shall automatically renew for three (3) additional twelve (12) month terms, with the final term ending on September 30, 2021.

For the initial term, the City shall pay BLM a lump sum payment of $35,000 upon execution of this agreement. For each additional twelve (12) month terms thereinafter, the City shall pay BLM $72,000. Beginning on October 1, 2019, the compensation shall be increased annually in an amount equal to 75% of CPI.

Exhibit C details the parameters set forth for approved category of future outdoor events. Two booked events are allowed. BLM may only have one (1) outdoor major fund raiser with amplified music or sound per fiscal year (Texas Gathering). Four (4) outdoor family nights will be permitted until 10pm. All other events are restricted to no amplified sound, no live music, a decibel reading not to exceed 68 dB during day time hours and 65 dB during nighttime hours, and activities ending by 7:00 pm.
