Title:
Consider and take action on an ordinance amending Chapter 54 of the Code of Ordinances of the City of League City entitled "Health and Sanitation" by adding language granting relief from ditch and/or easement maintenance in certain situations, and other minor administrative amendments (Director of Planning and Development)

Background:
February 13, 2017 - City Council conducts work session to discuss the City’s regulations regarding property maintenance/mowing; directed staff to bring back proposed regulations.
March 27, 2017 - City Council conducts follow-up work session on item; directs staff to bring forth ordinance amendment.
May 23, 2017 - City Council to consider proposed ordinance on first reading.
June 13, 2017 - If approved on first reading, City Council to consider ordinance on 2nd/final reading.

Project Summary:
Current ordinance requires all property owners to maintain the growth on their developed properties at a height of 12-inches or less, including that adjacent part of the public ROW to the curb or road edge. Recently, several property owners have conveyed various degrees of difficulty in maintaining the roadside ditches adjacent to their property. At the February 13, 2017, work session, the City Council directed staff to draft a proposed list of situations in which the City Manager or designee could use in determining whether to grant temporary relief. Such proposed language was discussed at the March 27, 2017 work session and the City Council directed City staff to prepare an ordinance for consideration.

The proposed ordinance amends the existing provision to provide specific conditions under which the City Manager or designee may grant temporary relief based upon one or more of the following:

1. Depth and/or slope of the ditch is too steep to mow safely;
2. Access to the ditch is limited;
3. The ditch is part of a non-HOA maintained drainage easement;
4. Ditch is located adjacent to a high traffic road;
