Background:
Approval of this resolution with authorize a standard utility agreement with TxDOT for the relocation and reimbursement of City-owned water and wastewater facilities in conflict with the IH-45 expansion project from Harris County Line to 0.4452 miles south of FM 518 (TxDOT Right-of-Way Project No. CSJ 0500-04-120.

Council approved a similar resolution (Resolution 2016-158) and standard utility agreement with TxDOT under Agenda Item 10J on November 8, 2016 for the IH-45 expansion project beginning at 0.452 miles south of FM518 and ending at League City’s city limit line north of FM 517.

This federally funded project is to widen this section of IH 45 to ten lanes and two 3-lane frontage roads. TxDOT opened bids in April, 2017 for this project and is making “fast-track” arrangement with the local utility providers for the relocations and adjustments along the project route. TxDOT has contracted with HDR Engineers, Inc. to prepare utility adjustment/relocation plans for this section through League City. To the extent possible, the City’s facilities will remain in place. The State will pay the City the costs incurred in adjustments, removals, and/or relocations up to the amount eligible for State participation.

Per the agreement, the City will be quit-claiming any easement interests the City has in the rights-of-way parcels being purchased in fee by the State for the widening.
