Consider and take action on a resolution approving utility conveyance and security agreements with Galveston County Municipal Utility District No. 14 for the following three development projects: Bayview, Section Two, Phase I; Bayview, Section Two, Phase II; and Bayview, Sections 3A, 3B, 4A, and 4B (Director of Public Works)
Background:
Approval of this resolution will approve utility conveyance and security agreements with Galveston County Municipal Utility District No. 14 (the “District”) for the following three development projects: Bayview, Section Two, Phase I; Bayview, Section Two, Phase II; and Bayview, Sections 3A, 3B, 4A, and 4B.
The District has constructed certain water, sanitary sewer, and drainage facilities and is formally conveying the facilities to the City pursuant to the Restated Utility Agreement dated January 22, 1999 (Ordinance No. 99-17), first amended on April 23, 2002 (Ordinance No. 2002-22), amended a second time on October 9, 2004 (Ordinance No. 2004-47), and amended a third time on October 11, 2005 (Ordinance No. 2005-22). Subject to a security interest retained by the District, the Agreement requires that these facilities be conveyed to the City for ownership, operation and maintenance.
The public infrastructure for these developments were accepted into the City’s system per the following table:
