Consider and take action on a resolution approving utility conveyance and security agreements with Galveston County Municipal Utility District No. 46 for water, sanitary sewer, and drainage facilities associated with the following: (1) Mar Bella, Sections 15A and 15B, (2) Mar Bella, Sections 16B and 16C, and (3) Mar Bella, Section 13B (Director of Public Works)
Background:
Approval of this resolution will approve utility conveyances and security agreements with Galveston County Municipal Utility District No. 46’s (the “District’s”) for the following: (1) Mar Bella, Sections 15A and 15B, (2) Mar Bella, Sections 16B and 16C, and (3) Mar Bella, Section 13B.
The District has constructed certain water, sanitary sewer, and drainage facilities and is formally conveying the facilities to the City pursuant to the Utility Agreement, by and between the City, the District, and Grason Communities Ltd. Development, approved on November 25, 2003 by Ordinance 2003-71. Subject to a security interest retained by the District, Section 1.03 of the agreement requires that these facilities be conveyed to the City for ownership, operations and maintenance.
The municipal infrastructure for these developments were accepted by the City Council on the following dates:
1. Mar Bella, Section 15A and 15B 12/08/2015
2. Mar Bella Section 16B and 16C 12/22/2015
3. Mar Bella Section 13B 10/13/2015
