Consider and take action on a resolution authorizing an Advance Funding Agreement with the Texas Department of Transportation for the replacement or rehabilitation of the bridge on McFarland Road at Drainage Ditch and related matters for an amount not to exceed $43,318 (Director of Budget and Project Management)

Background:
Approval of this item will authorize the City Manager to enter into an Advance Funding Agreement (AFA) with TxDOT for the replacement or rehabilitation of the bridge on McFarland Road at Drainage Ditch in the amount of $43,318, plus all right of way acquisition costs, if necessary. This is an estimate and payment will be based on actual costs. The existing bridge on McFarland Road, crossing a drainage ditch contributing to Dickinson Bayou, has been identified by the Texas Department of Transportation as structural deficient. This bridge was included in the approved Off-State System Federal-Aid Highway Bridge Replacement and Rehabilitation Program, as authorized by Texas Transportation Commission Minute Order Number 115005, dated August 31, 2017.

Per the attached project budget (Attachment D to the AFA), the City would be responsible for 100% of any needed Right-of-Way (ROW) acquisition. Estimated engineering costs ($75,180) and construction costs ($358,000) are to be split 90/10 between TxDOT ($428,862) and the City ($43,318), with any overruns being split in the same manner. Council will note that this AFA indicates the City will pay the State a total of $43,318; this does not include the costs for the City to acquire ROW or project overruns.

The State will be responsible for performance of the preliminary and final engineering work and will cooperate fully with the City to the degree permitted by the State and Federal law. The State’s construction responsibilities will include advertising for construction bids, issuing bid proposals, receiving and tabulating bids, awarding and administering the construction of the project.
