Council postponed 5-1-0 with 2 absent on February 27, 2018.

Background:
Approval of this item will relinquish all interest in a 1.04-acre (45,302 square feet) drainage easement situated in the John Miles Survey, Abstract 55, Galveston County, Texas.

On December 2, 2004, the previous property owner, Mr. Mearl L. Jones, executed a drainage easement in favor of the City. Mr. Jones recorded the deed in the Galveston County property records (see attached recorded drainage easement).

In order for a property conveyance to be legally binding on the City, the City Council is required to accept the conveyance by formal action. As the City had no need for the drainage easement, the City Council never took any action to accept the conveyance and City staff has never maintained the easement. Subsequent to the execution and recording of the easement deed, League City 210 Development Partners LP ("League City 210") acquired Mr. Jones’s interest in the property. League City 210 has requested that the City formally relinquish any interest in the drainage easement so that it may clear title to the underlining property.

Upon the approval of this agenda item, the City Manager will execute a quitclaim deed in favor of League City 210, which will be then recorded in in the Galveston County property records.

As of March 5, 2018, the 2017 League City and Galveston County property taxes pertaining to this property are paid in full by the property owner League City 210 Development Partners LP.
